Terms of Service

1. Acceptance of terms

Welcome. By accessing this platform, purchasing access to our online course bundles, or participating in our video classes, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our site or digital services.

2. Description of service

This platform offers digital access to structured yoga course bundles, each containing a set of instructional videos, drawn from years of teaching experience. Access to these streaming course bundles is provided upon completion of your purchase on this member portal (foundation.ayu.yoga).

3. Your account and access

To view your purchased course bundles you must register an account. You are responsible for keeping your sign-in details secure. Account access is strictly personal and non-transferable. You agree not to share, resell or distribute your credentials or your course access to anyone else.

4. Intellectual property and your licence

All video classes, course bundle structures, sequence designs, audio instructions and original materials on both our main website and this member portal are protected intellectual property.

  • Your purchase grants you a personal, non-exclusive, non-transferable licence to stream the course videos for your own practice.
  • You may not download, record, re-upload, publicly broadcast, or redistribute any part of the video bundles without our prior written permission.

5. Third-party hosting and technical access

Our course bundles and digital portals are hosted using third-party software and embedded video infrastructure. We work to keep access continuous, but we are not liable for temporary internet latency, personal device incompatibility, or third-party platform downtime beyond our control.

6. Account termination

We reserve the right to revoke account access immediately, without prior notice or refund, if you breach these Terms of Service, attempt to copy or download video content, or share your access with others.

7. Health, safety and liability

These practices carry health considerations, and participation is voluntary. Our wellness and liability waiver forms part of these Terms, and you accept it when you enrol.

8. Refunds

Purchases are handled under our refund and cancellation policy, which forms part of these Terms.

9. Standing monthly contributions (Ayu Friend)

You may choose to support the school with a contribution taken every month. This is optional, and nothing on this portal requires it. If you set one up, the following applies.

  • What you authorise. You choose the amount and the day of the month, between the 1st and the 28th. The amount you choose is charged immediately when you set the contribution up, and then on your chosen day every month afterwards, until you stop it. There is no fixed term and no minimum number of payments.
  • Changing or stopping it. You may change the amount, or stop the contribution altogether, at any time from your dashboard. You do not need to contact us or give a reason. Stopping takes effect at once and you will not be charged again. A change of amount takes effect from your next monthly payment; nothing is charged or refunded on the day you make the change.
  • What you receive. While your contribution is running we give you access to every course published on this portal, including any course we publish while it continues. This is given in thanks for your support rather than sold to you, and it is not the purchase of any particular course.
  • If you stop. The access you have already been given remains yours. We do not withdraw it, and you may keep practising with those courses. Courses published after you stop are not included.
  • Access is still governed by these Terms. Access given this way may be suspended or withdrawn for misuse of your account in the same circumstances as any other access, as described in section 6.
  • What we will email you. We write to you when your contribution starts, each time a monthly payment is taken, whenever you change the amount, when it stops, and if a payment does not go through. Every one of those messages carries a link to the page where you can change or stop it.

Contributions are handled under our refund and cancellation policy, which forms part of these Terms.

10. Governing law and disputes

These Terms, and any dispute arising out of them or out of your use of this portal, are governed by the laws of the State of California, without regard to its conflict of laws rules. You and we agree that the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any such dispute, and each of us submits to the personal jurisdiction of those courts.

If you live outside the United States, nothing in this section removes any right you have under the mandatory consumer protection law of the country you live in, including any right to bring a claim in your local courts where that law gives you one.

Before starting formal proceedings, please write to us. Almost everything is settled faster by email than by anything a court can do, and we will engage seriously with any complaint you raise.

11. What we do and do not promise

The portal and the course bundles are provided as they are. We do not warrant that the portal will be uninterrupted or free of errors, that any particular video will play on any particular device, or that the practices will produce any particular result. What you take from your practice is your own.

Limitation of liability exceptions. Nothing in these Terms shall limit or exclude either party’s liability for: (i) gross negligence, willful misconduct, or intentional wrongdoing; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable law.

12. Limit of our liability

To the maximum extent permitted by applicable law, and subject to the exceptions above, our total liability for any other claims is limited as follows:

  • we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, however caused;
  • our total liability to you for all claims relating to these Terms or to a course bundle is limited to the amount you actually paid us for that bundle in the twelve months before the claim arose.

13. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page tells you when they last changed, and we will email you at the address on your account if a change is material. Continuing to use the portal after that means you accept the updated Terms. A change never applies retrospectively to a purchase you have already made — the terms you agreed to at the time of payment are the ones that govern it.

14. If part of these Terms cannot be enforced

If any provision of these Terms is found to be unenforceable, the rest remains in force, and that provision applies in the narrowest form that is enforceable.

15. The whole agreement

These Terms, together with our wellness and liability waiver, refund and cancellation policy, delivery and access policy and privacy policy, form the whole agreement between you and us about this portal.
